1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of TuteNest, the website, web application, and related services operated by TuteNest ("TuteNest", "we", "us", or "our"). By creating an account, joining a tuition center on TuteNest, or otherwise using the service, you agree to be bound by these Terms and by our processing of your information as described here. If you do not agree, please do not use TuteNest.

2. Description of Service

TuteNest is a management platform for tuition centers and coaching institutes. It lets teachers create batches, mark attendance, share class agendas and holiday notices, raise and collect fee invoices, and communicate with students and guardians over WhatsApp and email. Students and guardians use TuteNest to view attendance, marks, fee status, and to make payments. TuteNest is a facilitation platform; it does not itself provide tuition, coaching, or educational instruction, and is not a party to the arrangement between a tuition center and its students.

3. Eligibility & Account Registration

Teachers registering on TuteNest must be at least 18 years old and must provide accurate, current information about themselves and their tuition center. You are responsible for keeping your password confidential and for all activity that occurs under your account.

Many students who use TuteNest are minors. Where a student is under 18, the account is created and used with the knowledge and involvement of a parent or guardian, whose contact details (name, phone, and/or email) are collected at signup alongside the student's own. By providing a guardian's details during student signup, the person completing that signup confirms they are the student's parent or guardian, or are authorized to act on the guardian's behalf, and consents on the minor's behalf to the collection and processing described in these Terms, consistent with the verifiable parental consent requirement under the Digital Personal Data Protection Act, 2023 for processing a child's personal data. We do not knowingly use a minor's data for behavioural monitoring, tracking, or targeted advertising.

4. Information We Collect

We collect the information reasonably necessary to run a tuition center on your behalf:

  • Identity & contact details: name, phone number, email address, and, for students, date of birth and (where applicable) a guardian's name, phone, and email.
  • Academic & operational records: the batches a student is enrolled in, attendance marks, marks/grades, class agenda entries, and timetable or holiday notices.
  • Payment information: fee invoice amounts, due dates, and payment status. Card, UPI, and bank details are collected and processed directly by our payment partner (see Section 7). TuteNest does not store your full payment card or bank account details.
  • Communications: records of OTPs, WhatsApp messages, and emails sent to you for verification, notifications, and (where you haven't opted out) service updates.
  • Technical information: basic device and usage information (such as browser type and IP address) collected automatically to keep the service secure and working correctly.

5. How We Use Your Information

We use the information above to:

  • create and secure your account, including OTP-based verification and login;
  • operate the core service: attendance, agenda, timetable, marks, and fee tracking for the batches you're part of;
  • send you transactional communications: OTPs, attendance/leave notices, holiday notices, and fee reminders, over email and/or WhatsApp;
  • process fee payments through our payment partner and reconcile them against your invoices;
  • maintain a record of teachers and students who have signed up, so that, where you haven't opted out, we can occasionally share service updates or announcements relevant to TuteNest; and
  • investigate misuse, enforce these Terms, and comply with legal obligations.

6. Communications & Marketing Opt-Out

Some communications from TuteNest are transactional and essential to the service: for example, login OTPs, attendance and leave notices, and fee reminders. These cannot be opted out of while you hold an active account, since they are how the service itself functions. Other communications, general updates or announcements not tied to a specific action you've taken, are optional. Every such email includes an "Unsubscribe" link that removes you from future communications of that kind; you can also write to care@tutenest.com at any time to ask about your communication preferences.

7. Payments

Where a tuition center enables online fee payment, TuteNest uses Cashfree, a licensed payment aggregator, to process card, UPI, and net-banking payments. When you make a payment through TuteNest, your payment details are entered directly into Cashfree's secure payment interface and are governed by Cashfree's own terms and privacy policy; TuteNest receives confirmation of successful payment but does not receive or store your full card or bank account numbers. Some tuition centers may also accept fee payment directly via UPI outside the payment gateway, in which case the payment is between you and that tuition center, and TuteNest facilitates recording it against your invoice based on information the center reports.

8. Third-Party Service Providers

To provide the service, we share the minimum necessary information with:

  • Cashfree: payment processing (Section 7).
  • Meta (WhatsApp Business Platform): delivering OTPs and notifications over WhatsApp, where enabled.
  • Google and Apple: if you choose to sign in with Google or Apple, for authenticating your identity.
  • Email delivery providers (Resend, Google Workspace/Gmail, or Zoho Mail): sending OTP, notification, and account emails.

These providers only receive what they need to perform their function and are contractually or by policy restricted from using your information for their own purposes. We do not sell your personal information to any third party.

9. Data Retention & Deletion

We retain your information for as long as your account is active and for a reasonable period afterward to meet legal, accounting, and dispute-resolution obligations (for example, payment and invoice records). You may request deletion of your account and associated personal data at any time by writing to care@tutenest.com, or, where available, directly from your account settings. We may retain limited information where required by law even after such a request.

10. Data Security

We apply reasonable technical and organizational security practices, including encrypted connections, hashed passwords, and role-based access controls, consistent with the reasonable security practices contemplated under the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your Rights

Under the Digital Personal Data Protection Act, 2023 and applicable Indian law, you have the right to:

  • access a summary of the personal data we hold about you;
  • request correction or updating of inaccurate or incomplete data;
  • request erasure of your data, subject to our legal retention obligations (Section 9);
  • withdraw consent for optional processing (such as marketing communications) at any time; and
  • register a grievance regarding how your data is handled (Section 15).

For a student account, these rights may be exercised by the account holder or, for a minor, by their parent or guardian.

12. Children's Privacy & Parental Consent

TuteNest is designed to be used by students of school and coaching-center age under the supervision of a parent, guardian, or teacher, as described in Section 3. We do not knowingly collect more information from a child than is necessary for the service to function, do not use a child's data for behavioural monitoring or targeted advertising, and do not sell a child's personal data. A parent or guardian who wishes to review, correct, or request deletion of their child's information may do so at any time by writing to care@tutenest.com.

13. Cookies

TuteNest uses a small number of strictly necessary cookies to keep you signed in and to keep the application working correctly. We do not use cookies for cross-site advertising tracking.

14. Intellectual Property & Acceptable Use

The TuteNest name, logo, and application are the property of TuteNest and may not be copied, reproduced, or used without permission. You agree to use TuteNest only for its intended purpose, not to attempt to gain unauthorized access to any account or data other than your own, and not to use the service to send unlawful, abusive, or unsolicited content.

15. Disclaimers, Limitation of Liability & Grievance Redressal

TuteNest is provided on an "as is" and "as available" basis. While we work to keep the service reliable, we do not guarantee that it will be uninterrupted or error-free, and we are not responsible for the accuracy of information (such as attendance, marks, or fee amounts) entered into TuteNest by a tuition center or its staff. To the maximum extent permitted by law, TuteNest's liability arising from your use of the service is limited to direct damages and shall not exceed the fees, if any, paid by the relevant tuition center to TuteNest in the preceding twelve months.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, grievances regarding content or data on TuteNest may be addressed to our Grievance Officer at care@tutenest.com, and we will acknowledge and address such grievances within the timelines prescribed by applicable law.

16. Termination

You may stop using TuteNest and request account deletion at any time. We may suspend or terminate access to accounts that violate these Terms, are used unlawfully, or where we reasonably believe continued access poses a risk to the platform or other users.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India, including the Information Technology Act, 2000, its associated rules, and the Digital Personal Data Protection Act, 2023. Subject to applicable law, any dispute arising out of or relating to these Terms or your use of TuteNest shall be subject to the exclusive jurisdiction of the competent courts at Karnal, Haryana, India.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in the service or in applicable law. Material changes will be posted on this page before they take effect. Continued use of TuteNest after such changes constitutes acceptance of the revised Terms.
